Baby, one more subpoena: Kevin Federline now wants Britney Spears’ rehab records.
K-Fed’s lawyer Mark Vincent Kaplan said today a chief administrator at Promises, the drug treatment facility where his ex-wife completed a stint last March, was served with a deposition subpoena over the weekend.
“Kevin and his attorney are on a mission,” said a source close to Federline’s legal team.
It was the fifth subpoena doled out by Federline’s lawyers, who are battling Britney for custody of the couple’s two young sons.
The pop star was released from rehab on March 21 after spending a month at Promises.
Her manager at the time said she “successfully” completed the treatment program but Spears has since been seen out partying.
Divorce lawyer Sue Moss, who is not tied to the case, said the Federline camp is trying to gauge just how successful Spears’ stay in the facility was and that the Promises records will most likely be admissible in court.
“Doctor-patient privilege only applies to the doctor or the nurse or somebody giving medical treatment,” Moss told the New York Daily News.
“It probably will not be expanded to an administrator.”
She added: “Because there is an issue of substance abuse and her mental state in this custody battle, the judge is probably going to allow it”.
Spears’ lawyer, Laura Wasser, is reportedly quitting the case and has advised the pop star about other legal representation.
Over the past week, Spears assistant Alli Sims, former assistant Shannon Funk, former bodyguard Daimon Shippen, and music producer Jonathan (JR) Rotem have all been served.
