ABS-CBN Broadcasting Corporation on Tuesday countered the motion filed by rival network GMA-7 which sought a temporary restraining order (TRO) from a Quezon City court to stop the airing of news related to the issue of alleged tampering in the ratings data released by AGB-Nielsen Media Research Philippines.
ABS-CBN maintained during its face off with its rival network at the Quezon City Regional Trial Court that by seeking a TRO, GMA-7 is violating press freedom and keeping people from knowing the truth.
“There are serious implications on the freedom of the press and the freedom of expression… It’s a little disheartening that the motion to stop the airing of news comes from itself from a media organization as well. It’s a gag order, you can not report. But what about the truth? Should not the truth come out?” said ABS-CBN lawyer Regis Puno.
Puno added that ABS-CBN has properly cited the statement of AGB-Nielsen General Manager Maya Reforma who said that the exposure of several panel homes were allegedly done by GMA-7 Network.
This statement, said Puno, is supported by the documents submitted by the AGB-Nielsen to the court.
“Do not prevent or shackle ABS-CBN from reporting the news as the same way that they would not want to be prevented from reporting the news,” said Puno.
Lawyer Gener Asuncion, legal counsel of GMA-7, denied that his client was out to suppress press freedom.
Asuncion said they only want to resolve the case at the court and not through media reports.
“We are only after the protection of our rights. Freedom is one thing. Abuse of that freedom is another. Injury to another as a result of that press freedom is definitely separate,” said Asuncion.
Judge Samuel Gaerlan of the Quezon City RTC Branch 92, however, suspended the presentation of evidence to decide if he will inhibit from hearing the case.
ABS-CBN has sought the inhibition of Gaerlan since his cousin is connected with the network’s legal department.
The network requested the inhibition to ease doubts that of being favored by the court.
Meanwhile, the ABS-CBN Management has presented to media Mark Dumago, the informant who exposed the alleged tampering of AGB meters in Bacolod.
Dumago reiterated his earlier statement that he and several others were involved in another TV station’s efforts to manipulate the ratings data collected by AGB-Nielsen
According to Dumago, the manipulation of ratings results was achieved by seeking out and then bribing households included in AGB-Nielsen panel homes. They reportedly offered panels homes money and groceries encourage them to watch GMA shows.
“Kapag may AGB meters, ico-confirm namin at bibigyan ng offer na P500 na monthly allowance at saka groceries (If they have AGB meters, we will confirm and offer them P500 monthly salary and groceries),” he said.

actually pareho lang naman silang nagkukuhanan ng talents. pero kadalasan naman decision ng mga stars and/or their managers kung saan sila magwo-work na station. Right?
so it’s not right naman na sabihing sila yung nagsusulutan ng talents.
so ang labanan nila is kung paano nila pasisikatin yung mga “nasulot” (which is according to you
) nilang stars.
and i think ABS CBN wins this fight
look at this. kapag yung mga artists nila wala sa tv, it’s either gumagawa sila ng movie or drama series. O kaya naman nasa ibang country para gumawa ng mga concerts.
yung GMA ginagamit lang nila yung iilan nilang sikat na stars. kaya tuloy nawawalan na ng gana mag-work sa kanila dahil napapagod na ng sobra (like Angel Locsin)

yung mga GMA talents nila walang breeding. i mean compare sa mga ABS CBN talents mas maganda yung pagkaka-build-up sa kanila.
Sa GMA kasi, kahit na hindi na maganda yung mga ugali nung talents nila, wala silang paki. Hindi maganda yung upbringing nila.
Unlike ABS CBN, kapag nagkamali yung talents nila (ex. nagdu-drugs, may mga misconducts, etc) pinagsasabihan or kaya sinususpend for sometime. pero ibabalik din naman nila agad
Dahil dito, lumalaking may magandang pag-uugali yung mga stars nila. And yung mga talents nila mostly pang-matagalan yung stardom.
It’s the total opposite when it comes to GMA. Andami nilang dinidiscover (like from Starstruck? Am I right?) pero sandali lang nawawala na. Ang alam kong sumikat lang sa kanila is Jennylyn Mercado (na example din ng walang right conducts dahil nagpabuntis bigla) and Mark Herras.

bago kayo maghatol ng iba hatulan nyo muna yang pinakamamahal nyong wowowee… mas lalong mandaraya yang iniidolo nyo…. tignan nyo yung wilyonaryo matinding ebidensya ng pandaraya… at ang stampede naman di pa binabayaran lahat ng mga biktima….. noon nagnakaw ng video galing sa gma ang ABS-CBN (video ng eye to eye at rally dispersal) at napatunayan ng korte na guilty ang ABS-cbn dito…

kung second rate lang ryan ang mga artista ng gma bakit sinusulot ng abs cbn ang mga talents ng gma? at karamihan ng mga artista sa abs cbn ay galing sa gma… at ikaw naman JM, hindi ka korte para magsabi o patunayan na nandaya ang gma. kung professional ang isang tao, dapat sa tamang lugar at proseso ang lahat… alam ng abs-cbn na matatalo sila sa korte at mapapahiya kaya sa media nila dinadaan ang pagiging malisyoso at mapambintang nila sa telebisyon…

Tama ka JM, bakit puro Mega Manila lang nirerelease ng PEP. Dati I always asked myself why mas mataas ang ratings ng mga shows ng channel 7 kesa sa mga shows ng 2. Example na lang why Sis dominates Boy & Kris, sa quality na lang ng show walang sinabi ang Sis, for me that show is walang katuturan, puro sayawan na madalas hindi mga marunong magsayaw, pinagsasayaw, ang mga host naman madalas lang yes ng yes or tungo ng tungo sa mga kausap, mahilig lang magpacute esp. Carmina, they can’t carry a conversation with their guests madalas nagbabasa lang sa idiot board. Panoorin nyo si Boy & Kris, naguusap na magkaharap, hindi tumitingin sa idiot board. Eat Bulaga vs Wowowee, excuse me pero kahit Tito, Vic and Joey pa yun, that show is so boring, magaling lang silang magparinig sa Wowowee, Wowowee ang saya-saya, esp Wheel of Fortune, kahit sino at anu ka pa, you’d given a chance to shine. Maraming nakikitang Pilipinong so talented in so many ways, singing, dancing, acting. sabi nga ni Vilma walang katulad ang Wowowee.. Now I know the answer, dinadaya pala ang ratings, maybe sa Metro Manila matagal ng dinadaya ang Ratings, wala sigurong gustong lumantad baka kasi dinoble or trineple na ang bayad. Yang Mike E. na yan dapat imbestigahan, kapal magsabi na pawang katotohanan, serbisyong totoo, mandaraya naman pala. Kaya pala hindi kayang magbayad ng 7 malaking talent fee sa mga artista, kasi malaki pala ang budget nila para manipulahin ang ratings.
